TikTok influencer Danisha Carter says AI artist Xania Monet stole her face – Here’s what you need to know:
Key Highlights:
- Influencer claims AI artist used her face without permission
- Carter contacted her lawyer about possible legal action
- Experts say proving AI data theft is nearly impossible
TikTok influencer Danisha Carter has 230,000 Instagram followers. She says AI artist Xania Monet stole her facial features to create the virtual performer’s look. Carter tweeted on November 1 that she called her attorney after seeing the similarities between her face and the AI singer. This happened weeks after Xania Monet became the first AI artist to chart on Billboard radio airplay charts.
Carter says the record company used her photos to make Xania Monet’s appearance. However, the AI artist was created before Telisha Jones got her $3 million record deal.
To be honest, I looked at the photos. There is some resemblance, but there are also features that are just not alike at all. Carter has called her lawyers, but I don’t think a lawsuit will hold up here.
Here’s why: The face of Xania Monet was created by an AI image generator, which means Carter should sue the company that developed the AI model, not Xania Monet or Telisha Jones. Jones is likely unaware that she generated an image that resembles someone else.
AI image models are trained on millions of images scraped from the internet, including social media platforms. But if a lawsuit comes up, Carter will have to prove the AI specifically used her image in its training dataset, and that will be very hard to accomplish. The burden of proof lies with Carter to show a direct connection between her photos and the AI-generated output, which is incredibly difficult given how these models work.
